Facility Registration and Policy Agreement

Release of Liability

In consideration of the use and availability of the services and facilities by me and all the individuals listed in my membership, including children and wards, if any, I hereby waive, agree to release, and discharge any and all claims for damages for personal injury, death, or property damage that I may have or that may hereafter accrue to me while enrolled in any class or program sponsored or organized by the Southlake Tennis Center (Roxy Tennis, LLC). This release is intended to discharge in advance the Southlake Tennis Center, the city of Southlake, its officers, employees, agents, co-sponsors, and volunteers from any and all liability, even though that liability arises, in whole or in part, out of ordinary negligence or carelessness on the part of the Southlake Tennis Center, the city of Southlake, its officers, employees, agents, co-sponsors, and volunteers, now and forever.

It is understood that participation in programs at Southlake Tennis Center involves an element of risk and danger of accidents, and knowing those risks, I hereby assume those risks. It is further agreed that this waiver, release, and assumption of risk is to be binding on my heirs and assigns. I agree to indemnify and to hold the Southlake Tennis Center and the city of Southlake, including its officers, employees, agents, co-sponsors, and volunteers, free and harmless from any loss, liability, cost, or expense that they may incur as the result of my death or any injury to me or property damage that I may sustain while participating in any activity now and forever, even though such loss, liability, cost, or expense arises, in whole or in part, out of ordinary negligence or carelessness on the part of the Southlake Tennis Center or the city of Southlake, its officers, employees, agents, co-sponsors, and volunteers.

Further, in case of accident, injury, or sudden illness, I authorize any first aid or emergency medical care that may become necessary for my child, ward, or me while utilizing Southlake Tennis Center. In addition, I authorize that my child, ward, or I may be transported to a local medical facility. If I cannot be reached in an emergency, I hereby grant permission for my child or ward named above to receive all appropriate medical treatment necessary. By executing this document, I hereby assume, on behalf of my child or ward, all risk of injury or loss to which he or she may be exposed.

In addition, I agree with and have read information regarding rules and regulations as outlined in the Membership Handbook of Southlake Tennis Center that include guidelines, rules, and policies.

Force Majeure

I agree to waive, forgive, release, and discharge any damages or injury caused by the occurrence of an event of Force Majeure. “Force Majeure” shall mean acts and events not within the Southlake Tennis Center’s control and which the city or its officers, employees, agents, co-sponsors, or volunteers have been unable, by the exercise of due diligence, to avoid or prevent. Events of force majeure include, without limitation: Acts of God; strikes, lockouts, or other industrial disputes; inability to obtain material, equipment, or labor; epidemics, pandemics, or other disease events; civil disturbances; acts of domestic or foreign terrorism; wars within the continental United States; riots or insurrections; landslides, lightning, earthquakes, fires, storms, floods, or washouts; arrests and restraint of rulers and people; interruptions by government or court orders; declarations of emergencies by applicable federal, state, or local authorities; present or future orders of any regulatory body having proper jurisdiction and authority; explosions; and breakage or accidents to machinery.

Equipment Rental

Some adult and junior classes will provide tennis racquets for players to ensure that the correct equipment is being used. I understand that this equipment must be returned no later than the last class session in its original condition, or there will be a $50.00 replacement charge for the racquet.

Withdrawals/Class Changes

Outdoor court reservations, private lessons, and drills require 24-hour notice for cancellation. Indoor court reservations cannot be cancelled once they have been booked. If players have been charged for a cancelled activity, they will receive an account credit for not attending.

All adult and junior classes require players to withdraw at least one week before the start of a session in writing. Once a session has started, there are no refunds for withdrawing from the program.

Auto Enrollment

By participating in the New To Tennis Program or the Junior Development Program, I understand that the program uses auto-enrollment to hold a space in the next session. I understand that I will be given at least one week’s notice to withdraw without penalty, but that I must withdraw by the deadline to avoid being charged for the next session. I agree to be charged one week prior to the session starting, and there are no refunds or credits once the program has started, even if the player does not attend the class.

Photo Permission

By participating in or attending any activity in connection with a program or utilizing the Southlake Tennis Center, whether on or off the premises, I, or on behalf of my child, consent to the use of any photographs, pictures, film, or videotape taken of me/my child or provided by me for publicity, promotion, television, websites, or any other use and expressly waive any right of privacy, compensation, copyright, or other ownership right connected to the same.

I HAVE CAREFULLY READ THIS AGREEMENT/WAIVER AND SUBMIT THAT I FULLY UNDERSTAND AND AGREE TO ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN THE ABOVE DEPARTMENT AND MYSELF. I HEREBY FURTHER SWEAR AND AFFIRM THAT I HAVE SIGNED THIS WAIVER AND RELEASE OF MY OWN FREE WILL. IN SIGNING FOR CHILDREN LISTED BELOW, I HEREBY REPRESENT THAT I AM FULLY AUTHORIZED TO DO SO ON THEIR BEHALF.
